General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions apply to all orders placed through the online shop of Mona Bilgeri, Berlinerstraße 10, 37073 Göttingen, Germany (hereinafter the “Seller”), by consumers and businesses (hereinafter the “Customer”).

2. Subject of the contract

The subject of the contract is the sale of original paintings and the creation of custom commissioned works of art.

Art prints may also be offered in the future, for example through print-on-demand services. These GTC also apply to such products unless expressly stated otherwise.

3. Conclusion of the contract

The products displayed in the online shop do not constitute a legally binding offer. By submitting an order, the Customer makes a binding offer. The contract is concluded once the Seller confirms the order by email.

4. Prices and small business tax status

All prices are final prices. No VAT is charged or shown pursuant to Section 19 of the German VAT Act (UStG). Any shipping costs are listed separately.

Any applicable import duties, customs charges or taxes must be paid by the buyer.

5. Payment terms

Payment is made using the payment methods offered in the shop (PayPal, credit card). The purchase price is due immediately upon conclusion of the contract, unless otherwise agreed.

6. Shipping and delivery

Shipping is available within the EU only.

Shipping to countries outside the EU is possible only by prior individual agreement. Any applicable customs duties, import charges or taxes must be paid by the buyer.

Original works are carefully packaged and shipped with insurance. Delivery times are stated in the relevant product listing.

7. Retention of title

The goods remain the Seller’s property until payment has been made in full.

8. Commissioned works (custom artwork)

For commissioned works, following a consultation and a subsequent quotation, a 50% deposit of the agreed total price is due once the Customer accepts the quotation.

The remaining 50% is due upon completion, before delivery or handover.

Custom-made artworks are excluded from the right of withdrawal (Section 312g(2)(1) of the German Civil Code (BGB)).

Artistic freedom and the nature of the handcrafted process may result in minor deviations from sketches or designs. Such deviations do not constitute a defect.

9. Right of withdrawal

Consumers have a statutory 14-day right of withdrawal when purchasing non-personalized original works.

There is no right of withdrawal for custom commissioned works.

The withdrawal notice is available separately on the website.

The buyer pays the return shipping costs unless otherwise agreed.

10. Prints / print-on-demand

If art prints or print-on-demand products are offered, they may be produced by external service providers. Delivery times may therefore vary.

Personalized or individually produced prints may be excluded from the right of withdrawal if they are made to the Customer’s specifications.

11. Transport damage

Any visible damage incurred during shipping must be reported to the carrier immediately and communicated to the Seller promptly.

12. Copyright and usage rights

All works are protected by copyright. The purchase of a work does not transfer any usage or reproduction rights unless expressly agreed otherwise in writing. Reproductions, commercial use or publication require the artist’s consent.

13. Warranty

Statutory warranty rights apply.

14. Liability

The Seller is liable without limitation in cases of intent or gross negligence, and for injury to life, body or health. In cases of slight negligence, the Seller is liable only for breach of material contractual obligations and only up to the foreseeable amount of damage.

15. Online dispute resolution

The European Commission provides an online dispute resolution platform:

https://ec.europa.eu/consumers/odr

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions state otherwise.

Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
